TERMS AND CONDITIONS

Welcome to Healthspan Clinics (“the Clinic,” “we,” “our,” or “us”), a medical longevity clinic located in the United Arab Emirates. These Terms and Conditions (“Terms”) govern your use of our services, including but not limited to in-person clinical consultations, medical assessments, treatment plans, online resources, and any other services we offer (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

1. DEFINITIONS

1.1 “Patient” or “You” refers to the individual receiving Services from the Clinic.

1.2 “Parties” refers to both you and the Clinic collectively.

1.3 “Services” includes medical consultations, diagnostics, treatments, wellness programs, and other related healthcare or longevity services provided by the Clinic.

2. ACCEPTANCE OF TERMS

2.1 Binding Agreement

By scheduling an appointment, registering for an account, completing a consultation, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy.

2.2 Updates to Terms

We reserve the right to modify these Terms at any time. Any updates will be effective immediately upon posting on our website or upon notification to you in writing, whichever occurs first. Your continued use of our Services after any changes signifies your acceptance of the new Terms.

3. SCOPE OF SERVICES

3.1 Medical Longevity Services

The Clinic specializes in providing personalized medical advice, preventative care, advanced diagnostics, and treatment plans aimed at promoting longevity and overall wellness. Our providers may include medical doctors, dietitians, physical therapists, personal trainers and other licensed healthcare professionals in the UAE.

3.2 No Guarantee of Results

Longevity and wellness outcomes vary among individuals based on factors such as genetics, lifestyle, and adherence to prescribed treatment plans. While we strive to provide the highest quality of care, results are not guaranteed and the clinic holds no liability regarding this.

3.3 Eligibility

You must be at least 18 years old to use our Services.

4. MEDICAL DISCLAIMERS

4.1 Professional Judgment

Our healthcare professionals will use their best professional judgment to tailor your medical care, but this does not replace the need for you to communicate openly about your medical history and current health conditions.

4.2 External Consultations

Our Services are designed to work in tandem with other medical care you may receive. You are responsible for following up with your primary care physician or other specialists as recommended.

4.3 Emergency Situations

The Clinic is not equipped to handle medical emergencies. If you are experiencing a medical emergency, please contact local emergency services (998/999 in the UAE) or go to the nearest hospital.

5. APPOINTMENTS AND CANCELLATIONS

5.1 Scheduling

Appointments can be made via phone, email, our website, or in person. We will do our best to accommodate your preferred appointment times, but availability is subject to scheduling constraints.

5.2 Late Arrivals

If you arrive late, your consultation may be shortened or rescheduled based on provider availability. Full service fees will still apply.

5.3 Cancellation Policy

A minimum 7 day notice is required for cancellations or rescheduling, except in cases of emergency. Failure to provide adequate notice may result in a cancellation fee as specified in our fee schedule.

6. FEES AND PAYMENT

6.1 Consultation Fees

All fees for consultations and treatments will be communicated to you prior to or at the time of your appointment. Fees may vary depending on the type of service, provider expertise, and complexity of care required.

6.2 Payment Methods

We only accept cash or credit/debit cards as payment methods.. Payment is typically made prior to the time of service unless otherwise agreed upon.

6.3 Insurance

We do not accept direct billing from insurance companies.

6.4 Refunds

Once the clinical process of the first consultation has started there will be no refunds for any part of the package. If a cancellation is made without due notice (sec 5.3] 50% of the package fee will be retained by Helathspan Medical LLC. Generally, refunds are processed only under specific circumstances and at the Clinic’s discretion.

 

7. PATIENT RESPONSIBILITIES

7.1 Accurate Information

You agree to provide accurate, up-to-date, and complete information regarding your personal details, medical history, and current health status. Failure to disclose information could hinder our ability to provide safe and effective care. The Clinic reserves the right to terminate services based on inaccurate or witheld clinical information without possibility of refund.

7.2 Compliance

You are responsible for following the treatment plans, medication regimens, and lifestyle recommendations provided by our healthcare professionals. Failure to do so may affect your health outcomes.

7.3 Respectful Conduct

We require patients and visitors to behave respectfully toward our staff and other patients. Harassment, verbal abuse, or disruptive behavior may result in termination of care.

8. PRIVACY AND DATA PROTECTION

8.1 Collection of Personal Information

We collect personal information (such as name, contact details, and medical history) in accordance with applicable UAE data protection laws for the purpose of providing you with quality healthcare.

8.2 Use of Information

Your personal information is used strictly for delivering healthcare services, coordinating care, and improving patient experience. We may use aggregated or de-identified information for quality assurance, research, or statistical purposes.

8.3 Disclosure

We will not disclose your personal or medical information to third parties except as required or permitted by UAE law, such as to regulatory bodies, healthcare regulators, insurance providers (with your consent), or as necessary to deliver safe and effective care.

8.4 Security Measures

We implement industry-standard security measures to protect your data, including secure storage of medical records, encryption of digital data where appropriate, and strict access controls.

9. INTELLECTUAL PROPERTY

9.1 Clinic Materials

All materials provided by the Clinic, including but not limited to written instructions, educational content, website text, images, and logos, are protected by intellectual property laws. You may not reproduce, distribute, or otherwise use Clinic materials without express written permission.

9.2 Trademarks

The Clinic name, logos, and any service marks displayed on our materials or website are the property of the Clinic. You are prohibited from using these marks without prior written consent.

10. LIMITATION OF LIABILITY

10.1 Medical Complications

While our providers are fully licensed and qualified, healthcare services carry inherent risks. The Clinic will not be liable for any complications, injuries, or losses arising from procedures or treatments, except to the extent mandated by UAE law.

10.2 Indirect Damages

To the fullest extent permitted by law, we shall not be liable for indirect, incidental, punitive, or consequential damages arising out of or in connection with the use of our Services.

10.3 Force Majeure

We will not be liable for any delay or failure to perform our obligations where events beyond our reasonable control (e.g., natural disasters, acts of government, pandemics, or disruptions in public utilities) prevent us from providing Services.

11. THIRD-PARTY SERVICES AND LINKS

Our website or informational materials may reference or contain links to third-party resources or services that we do not own or control. We are not responsible for the content, privacy policies, or practices of these third parties.

 

12. COMPLIANCE WITH UAE LAWS

12.1 Local Regulations

The Clinic is established under and governed by the laws of the United Arab Emirates, including regulations by relevant healthcare authorities such as the [DHA (Dubai Health Authority)] or [HAAD (Health Authority-Abu Dhabi)], depending on our location.

12.2 Ethical Standards

All medical procedures, consultations, and recommendations provided by the Clinic adhere to applicable UAE medical regulations and professional ethical standards.

13. TERMINATION

13.1 By the Clinic

We reserve the right to terminate or suspend any Patient’s access to our Services at any time if the Patient breaches these Terms, provides false information, fails to comply with treatment protocols, or engages in misconduct.

13.2 By You

You may discontinue using our Services at any time; however, you remain responsible for any outstanding fees incurred up to the date of termination.

14. DISPUTE RESOLUTION

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the UAE.

14.2 Jurisdiction

Any dispute or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts covering the Meydan Free Zone.

14.3 Informal Resolution

We encourage Patients to first seek to resolve any concerns informally by contacting our administrative office before initiating legal action.

15. MISCELLANEOUS

15.1 Severability

If any provision of these Terms is found to be invalid or unenforceable under UAE law, that provision will be deemed severed from the Terms and will not affect the remaining provisions’ validity and enforceability.

15.2 Entire Agreement

These Terms, together with our Privacy Policy and any additional documents expressly incorporated by reference, constitute the entire agreement between you and the Clinic regarding your use of the Services.

15.3 No Waiver

Our failure to enforce any right or provision under these Terms shall not constitute a waiver of future enforcement of that right or provision.

15.4 Language

These Terms may be provided in multiple languages. In the event of any conflict or inconsistency between the English version and a translated version, the English version shall prevail (unless otherwise required by UAE law).
